The Supreme Court of California denied the writ of review sought by Phil Kay, and imposed the recommended three year actual suspension.
At the moment, it is unclear to TLR as to, if and when, the Supreme Court order will take effect, as there is still a suit pending in San Francisco Superior Court in connection with various irregularities which took place during Kay's hearing before the State Bar Court.
Previously, a similar three year actual suspension was also imposed by the California Supreme Court on State Bar Court judge Judith Epstein's former business partner and convicted felon--Malcolm Wittenberg.
Kay, who is a sole practitioner, did not contribute money to the State Bar Foundation, and none of his business partners serve on the Board of Governors of the State Bar of California.
