Few weeks ago the State Bar of California, an otherwise governmental entity, continued with its now notorious shenanigans and took it upon itself to engage in the practice of "Selektzia".

The term "Selektzia" is and should not be a strange term to the Jewish people. It denotes the process of classifying and separating people according to their race, religion, and physical features as was practiced in Europe for purposes of discrimination.

The practice of Selektzia was utilized both formally and informally. For example, a teacher acting on a whim will allow only Aryan pupils with natural blond hair and blue eyes to sit in the front of the class. Slavic, Poles, Jews, and Gypsies were allowed only at the back of the classroom. Similarly, a law-firm in Germany might choose to omit photos of non-Aryan associates from promotional literature, for example.

During World War II, King Muhammad V refused direct instructions from France and Germany to engage in selektzia by separating the Jews from the rest of the population and ship them to the camps in Poland. "There are no Jews in Morocco, there are only subjects," the king stated.

As such,it was shocking to observe the former and current presidents of the State Bar of California -- Messrs Howard Miller and Bill Herbert,  both of whom are Jewish --  engaged in the practice of Selektzia with a smile on their faces as their respective law-firms obtain financial benefit.

Ms. Sonja Francine Marie Diaz (AKA Sonja Diaz) who according to the State Bar of California is the "eldest daughter of two highly educated chicanos" received $5000 from the State Bar of California for the sole reason of being a latino. The State Bar of California's Sleketzia ceremony, which was conducted under color of state law and by governmental officials, took place as part of a program in which the State Bar of California awards "Diversity Scholarships" to minorities only. White Need Not Apply.

28 law students shared $180,000 amongst themselves for the sole reason of being Latinos, African-Americans or APA.

Ms. Sonja Diaz, who according to the State Bar is the daughter of two highly educated chicanos, was awarded $5000 for the sole reason of being a latino. While the argument can and should be made that Ms. Diaz would have been a perfect candidate for a "Public Interest" scholarship, she should not have received any money for being a Latino.

"There are no Blacks, APA, or Latinos in the U.S., there are only Americans," Brodie stated.

Yesterday I was privileged to get a glimpse into the world of prima ballerina Dame Ninette de Valois and the history of The Royal Ballet companies at an exhibition at the Lowry.

The exhibition is a tribute to Ninette de Valois, the founder of The Royal Ballet, who later also established the Birmingham Royal Ballet and the Royal Ballet School.

The truly exuberant first part of the exhibition includes de Valois' outfits, memorabilia, costumes and photographs taken over the years.

As one progresses through the exhibition, the focus shifts from de Valios to contemporary dancers of The Royal Ballet as well as behind the scene look at the entire coordination and presentation of a performance.

The exhibition is on until 6th March and entry is free.

In light of the controversial circumstances surrounding professor Wagstaffe's waggery and lack of integrity, a growing sense of unease is developing over the contents of his friendly Facebook page.

At issue is Professor Wagstaffe's virtual friendship with several students who attend U.C. Hastings College of the Law.

TLR is of the opinion that a student and a teacher should not be "Facebook Friends."

Such practice is wholly inappropriate and should be banned. Not only that it creates the appearance of favoritism, it is also counterproductive to a healthy professional distance and formality that should exist between a student and a teacher.

Such virtual friendships also provides a greater opportunity and ease for either the student or the teacher to engage in various acts of misconduct.

Past TLR's reportage of Wagstaffe's repertoire should also serve as fodder in favor of implementing a policy prohibiting teacher-student friendship on Facebook.

Circumstances surrounding activities by Eric George/Bet Tzedek in connection with filing a brief with the California Supreme Court (as well as other activities at Bet Tzedek) were assailed by Prospective Petitioner John Doe (writvcalbar@gmail.com) as "legally questionable and morally dubious."

Anonymous sources confirmed to TLR a major concern is the potential conflict of interest and lack of disclosures on the part of Bet Tzedek, Eric George, and Justice Ronald George.

A former Senior Counsel with the firm of Buchalter Nemer, Mr. Cyrus Sanai, was sanctioned by the Ninth Circuit Judicial Council for filing frivolous complaints against 19 federal judges.

The Ninth Circuit council "publicly reprimanded" Sanai and sent a copy of the recommendation to the State Bar of California for further review.

Sanai, a graduate of Harvard School of Law, is no stranger to controversy and was previously sanctioned by a Washington State judge for various acts of misconduct the judge found to be “outrageous, disrespectful, and in bad faith.”

Previously, many speculated the failure of the State Bar of California to pursue disciplinary action against Sanai was due to his close association to Buchalter Nemer and to otherwise spare Buchalter Nemer the embarrassment, bad publicity, and potential loss of revenue.

Buchalter Nemer, as TLR's readers are aware, is a major contributor to the Foundation of State Bar of California, a sponsor of Bet Tzedek.

Bet Tzedek is an affiliated agency of "The Jewish Federation of Greater Los Angeles."

The Jewish Federation of Greater Los Angeles as well as the State Bar of California were both beneficiaries of Girardi & Keese's Howard Miller's efforts and contribution.

Please excuse my delay in communicating with you. I am still recovering from the 18 months of incarceration.

On behalf of my wife Maryellen, my daughter Tory and myself, I thank you for all of your prayers and efforts to help win my freedom.

The fight against corruption and to restore our judicial system is not easy. However, together, we have demonstrated that we will not allow our constitutional rights to be destroyed by corrupt judges. Judge Yaffe resigned from office after I reported him to the California Commission on Judicial Performance and sought his removal. Ronald M. George, the Chief Justice of the California Supreme Court who knowingly oversaw the illegal county payments to the California judges has resigned from office rather that run for re-election. We have had an impact. We currently have requests for grand jury investigations of judges pending and requests for congressional investigations pending. The crusade is gathering steam.

We must now be ever vigilant to vote out all judges and justices in California who received the illegal payments, ensure that corruption does not occur in other states and in the federal judiciary, and pursue our grand jury and congressional investigations.

We now have the momentum! Let us continue together to victory.

Once again, a BIG thank you. Without your prayers and support, I would never have survived this ordeal.

President Obama stated to the bloggers: "websites like you guys do every day two things. Number one it allows us to reach audiences that may not be watching Meet The Press. I'm just saying, it might be a different demographic. But the second thing is obviously part of what is so powerful about the web, is that it's not just a one-way conversation."

According to the Daily Mail, few of the bloggers accused Barack Obama of using them for political expediency and demanded the same level of access as other mainstream media. One blog, Jack and Jill Politics, said: 'We essentially told the White House that we are not willing to be "pimped".

Keli Goff, a blogger who writes for theloop21.com, said: 'I respect that the second half of the briefing was off the record, but I feel comfortable enough to say I think we made it clear that we want to be taken just as seriously and receive the same measure of access as the mainstream outlets already do. This was a good first date. Now let's see if there is some substance there going forward."

According to Jack and Jill Politics Ms. Valerie Jarrett, an adviser to Obama, committed to conducting more meetings with black bloggers.

TLR is in receipt of yet another piece of evidence which clearly demonstrates mistreatment and inequality at the racist/sexist law firm of Kerr & Wagstaffe.

An avid reader of TLR has informed us that upon the hiring of Ms. Kelly Anne Corcoran, in addition to quickly posting her picture on the firm's site, the firm commemorated this news worthy event by issuing an "announcement" to the press and the public.

On March 16, 2009 Kerr & Wagstaffe stated it was "pleased to announce our newest associate Kelly A. Corcoran."

While standing alone, such an "announcement" is insignificant. Kerr & Wagstaffe will be hard pressed to explain its failure to issue a similar announcement when it hired the faceless associate, Mr. Daniel Zaheer.

(NGO) again called upon the Los Angeles Jewish and legal communities to assume accountability for the conduct of Bet Tzedek -”The House of Justice”, since the evidence showed that Bet Tzedek, “The House of Justice”, had evolved into a mixed use organization. While it may still be an effective provider of free legal services, it also doubles as the seat of various other enterprises, which must be deemed contrary to both its mission and the law, and were alleged as racketeering.

The recent reports involving Holly Fujie, included, but were not limited to the transfer of funds from the Foundation of the State Bar of California to Bet Tzedek.

Three former senior officers of Bet Tzedek, Sandor Samuels (then President of Bet Tzedek and Chief Legal Officer of Countrywide Financial Corporation), David Pasternak (former President of Bet Tzedek), and Terry Friedman (former Executive Director of Bet Tzedek and Judge of the Los Angeles Superior Court) were previously involved in conduct that was initiated on the grounds of Bet Tzedek, and was alleged in complaints filed with the US Attorney Office as racketeering.

Combined, Bet Tzedek - "The House of Justice", is therefore directly involved in conduct that was documented in Human Rights Alert's April 2010 submission to the United Nations Human Rights Council, and which has recently been referred to in the United Nations Human Rights Council staff report as "corruption of the courts and the legal profession... in Los Angeles County, California."

Mitch Kamin, President of Bet Tzedek, refused to respond on repeated requests to address conditions at Bet Tzedek, and so did the Los Angeles Jewish Federation, with whom Bet Tzedek is affiliated.

Brodie, on assignment to cover the trial of Geert Wilders for inciting hatred against Muslims, was due to arrive yesterday.

An attempt to secure an interview with Wilders attorney, Bram Moszkowicz , caused substantial delays.

As previuosly mentioned, Brodie traveled by ferry from Amsterdam to Dover to Victoria Station.  From there, she was whisked back home by a family member.

It will also incorporate criticism of various law-firms, as well as much deserved criticism of  "The Volokh Concpiracy"  (www.volokh.com)  for its failure to incorporate a female writer. Presently, all 19 contributors to the blog are men.

Brodie informed TLR to prepare for an "important announcement."

Reactions to the stories we have published concerning Kerr & Wagstaffe continue to pour in.

Most, almost all, were supportive of the firm.

Expressing their opinion in support of the firm were also a gifted mathematician and a soccer-hooligan, Messrs. Lammers and Randazza, respectively, both of whom are attorneys.

According to Ken, a self proclaimed "Blawger" who analyzed Kerr & Wagstaffe very carefully on his "Blawg", in the San Francisco Bay Area the breakdown of lawyers' ethnicity is as follows:

85% White, 13% Hispanic, and 6% Asian.

Apparently, Ken and Simon Cowell have at least one common denominator; they both invented new numbers. Simon Cowell invented "Billion Percent" (I am told it can only go as high as 100%). Ken invented 104 percent.

Ken might have forgotten to include, perhaps conveniently, the number of African-American attorneys in his figures. At least according to his calculations, they do not exist.

Armed with his 104%, Ken decided to go a step further when examining Kerr & Wagstaffe; he decided, perhaps conveniently, to not include the female associates as part of his calculations!

Ken wrote: "let's look at the law firm before it undertook the hiring of the various ladies, which seems to be a more recent occurrence."

Ken, after crunching the numbers, crunched some more numbers, and his ultimate conclusion is "The 6th spot really should have gone to an Hispanic."

Mr. Randaza, who possess a surprisingly similar background to that of Mr. Wagstaffe (both are members of the State Bar of California, both are "First Amendment Lawyers", both with background in journalism, and both with a history of representing the porn industry, such as sex.com), used words and metaphors rather than numbers.

Most of what Randazza conveyed to TLR is obscene and otherwise unpublishable. Part of what he wrote include:

"That firm has 11 lawyers -- hardly enough to allow any conclusions to be drawn from its ratio of vaginas or melanin to partners."

"Furthermore, even if it happened to be 111 lawyers, with all of them white males over 50 years of age, I still would not give a shit."

Rhandazza suggested that we contact Katharine MacKinnon or Mari Matsuda, who might take us seriously.

Hastings' Chialei Hsu suggested: "stop whining. I also know law firms that have not post the photos of their white associates who are with them for over a year. Good luck."

 

A member of a sister congregation located in Walnut Creek, CA  U.S.A  will file an original action with the California Supreme Court by the end of next week, TLR has learned.

The original action, which will be presented to the Supreme Court of California in the form of Writ of Mandamus/Prohibition, based on its original jurisdiction over the State Bar of California, will seek an order prohibiting the State Bar of California and its Foundation from accepting money from law-firms and members of the State Bar of California

The confidential source claims he would have liked to seek legal counsel form Richard Fine concerning the funneling of funds from private law-firms(such as Girardi & Keese and Buchalter & Nemer), yet, he could not do so as Mr. Fine is currently not eligible to practice law.

The source claims Mr. Fine's disbarment is invalid based on specific rules of practice and procedures which prohibited Judge Remke from appointing a civilian (Mr. Ronald Stovitz) to sit by designation in the proceedings concerning Fine and others.

Previously, TLR covered the alleged misconduct conducted by Mr. Stovitz from a different perspective. TLR's position involved violation of the Business and Professions Code, unlike the new allegation which involves State Bar Court Rules of Practice and Procedures.

TLR has also learned the suit will seek an order prohibiting the Foundation from awarding "Diversity Scholarships" as, according to the source, violate multiple federal/state statutes, and are otherwise discriminatory.

D E V E L O P I N G......

In Part 1 of the "Suspicious Minds" series ("James Wagstaffe+Young White Females = Suspicious Minds") TLR discussed Kerr & Wagstaffe's proclivity towards hiring young white females as associates.

It also relates the role of James Wagstaffe as a part-time, Civ-Pro teacher at Hastings College of the Law.

Prof. Wagstaffe, in his capacity as a teacher, wrote a letter of recommendations/reference on behalf of one of his student—Ms. Regina Ames. Ms. Ames, as you correctly guessed by now, is also a young white female.

Wagstaffe wrote:

"I would say without hesitation that Ms. Ames was one of the best students in last year's class-- or in any year for that matter. I suspect that her B grade in the course resulted more from the fact that she was perhaps over-prepared for the blindly-graded final examination." (Emphasis added)

In reply, we wrote:

"Do you suspect Wagstaffe's suspicion about the unsuspicious B grade is suspect, like I suspect? Or,caught in a trap, you suspect otherwise?"

At the moment, the failure of Kerr & Wagstaffe to post on its website a photo of its newest Hindu-American associate, Mr. Daniel Zaheer, despite the passage of five months since he was hired, should also be viewed as suspect.

Particularly if one incorporates into the picture some Wagstaffe's waggery.

Prof. Wagstaffe, took considerable measures to impress potential clients when the firm was established. "We wanted to look like we're already successful." Wagstaffe also stated: "we wanted our clients to say: 'These guys are doing great!'" "That meant Bay views and associate salaries that matched."

Leslie Brodie – who is on assignment and could only reached by telephone stated "We need to empower women and minorities to believe in themselves, and not compromise for the short end of the stick, including empowering Mr. Zaheer, who may suffer from colonialism related inferiority complex, that he is as good as Dawn Marie Melton, Adrian Sawyer, and Holly Hogan," Brodie continued.

"We need to break that psychological barrier," Brodie concluded.

Due to recent developments and discoveries concerning Ms. Holly Hogan, TLR will not be able to conduct any of the activities schedules for Wednesday. Those activities will be conducted soon.

Holly Hogan, a former associate with the firm of Kerr & Wagstaffe, used the word "partnership" on her LinkedIn profile in reference to her employment with Kerr & Wagstaffe.

TLR is in the process of examining the discrepancy between Ms. Hogan's LinkedIn representation to information and data we posses.

In the meantime, out of abundance of caution, TLR will continue to maintain that Ms. Hogan was never made partner at Kerr & Wagstaffe, notwithstanding the use of the word "partnership" in Ms. Hogan's LinkedIn profile.

It could be the case that "partnership" is in reference to the the fact that Kerr & Wagstaffe is organized as a "partnership".

Nevertheless, this issue deserves our attention which we hope will be resolved by Tuesday, once Leslie Brodie is back from her assignment.

TLR encourages the readers not to draw any conclusions about Ms. Hogan. As mentioned, the likely explanation is that "Partnership" is in reference to the firm's structure.
