  • Muslim Community of Orange County Mulls Aiding Ronald Gottschalk

    Representatives of the Muslim community of Orange County, the Church of Latter Day Saints, and the Christian right, along with various civil rights activists, are in discussions to establish a plan of action to aid Orange County resident Ronald Norton Gottschalk, The Leslie Brodie Report has learned.

    During a meeting held in Arcadia yesterday, luminaries set the stage for the creation of a platform that will be used in aiding Gottschalk's whistleblowing activities and his quest for justice.

    Gottschalk, an accomplished attorney with a stellar record, has been the victim of grave injustices and systemic abuses from various local and state entities ever since his relationship with Thomas Girardi of Girardi & Keese soured.

    Knowledgeable sources maintain that representative of the Orange County Jewish Federation and related entities were intentionally excluded from these discussions so as to avoid conflicts of interest and future complications. In addition, there were concerns that information may leak to the Los Angeles Jewish Federation and Bet Tzedek – both entities with strong ties to Girardi & Keese partner Howard Miller, as well as Ronald George – the former Chief Justice of the California Supreme Court, respectively.

    Eric George (Ronald George's son) is an active board member of Bet Tzedek. Previously, the State Bar of California – one of the entities engaging in the systemic abuse of Gottschalk – declined a request to disclose the amount of money it transferred to Bet Tzedek, as well as the amount of contributions it obtained from its members and related law firms. Unlike its foundation – the California Bar Foundation, which discloses financial transactions on a regular basis – the State Bar of California itself only discloses the names of the entities upon which it bestows money, and does not enumerate the dollar figures involved.

    According to the California Bar Journal, during the State Bar's annual meeting in Monterey last September, Girardi & Keese and Thomas Girardi had an orchestra, along with singer-songwriter Paul Anka, flown in to perform at a special reception for retiring Chief Justice Ronald George.

    The enmeshment between Thomas Girardi and the State Bar of California and others has been the subject of extensive coverage on TLR in connection with former crack addict Mike Nisperos ; BOG public member Jeannine English; State Bar of California Investigator Tom Layton; State Bar of California Executive Director Joe Dunn; allegations of preferential treatment leveled by ethics specialist David Cameron Carr; the attorney-client relationship between Howard Rice and Girardi & Keese; matters relating to the MGA/ Mattel litigation; as well as allegations involving conflicts of interest involving the case of Fogel v. Farmers.

    Separately, TLR has learned that an examination is underway relating to the relationships, if any, between Ronald George and former State Bar of California president and Chairman and Chief Executive Officer of 1st Century Bank Alan Rothenberg, as well as the relationship between Eric George and the San Francisco based law firm of Howard Rice Nemerovsky Canday Falk and Rabkin in matters relating to multimillion dollar litigation against the Walt Disney Company regarding unpaid royalties involving fictional character Winnie the Pooh.

  • United States Supreme Court Asked to Review Alleged Corruption Within California Supreme Court

    Lending significant support to calls for an examination of corruption in the California Supreme Court, a sharply-worded brief was filed with the United States Supreme Court, urging it to grant review.

    In that brief, Marina Del Ray-based legal scholar Dan Dydzak minced no words in accusing former Chief Justice Ronald George and attorneys from the San Francisco-based law firm of Howard Rice of egregious misconduct.

    Specifically, it is alleged that Howard Rice was instrumental in using the State Bar of California/State Bar Court as a vehicle to punish Dydzak for his role in exposing alleged corruption and improprieties at brokerage house Charles Schwab, an established client of Howard Rice.


    Mr. Jerome Falk of Howard Rice, an appellate specialist with a mercurial personality. In 2008, during an interview with a legal publication, Mr. Falk stated while describing some opposing counsel, "I would do anything to squash them. So those cases don't settle.     Dydzak alleges improprieties on the part of State Bar Court Judge Donald Miles, a former partner at Howard Rice, as well as Sean SeLegue, a current Howard Rice partner, and a cover-up by the California Supreme Court due to the close relationship between Ronald George and Howard Rice.

    Allegations of egregious misconduct, ethical violations, and appearances of impropriety have become commonplace against embattled Howard Rice.

    Recently, California's First District Court of Appeal ruled that the failure of Howard Rice partner Sean SeLegue to disclose at the time of an arbitration (in which he served as arbitrator) that he generally defended attorneys and law firms in cases involving professional responsibility, along with the fact that he was actively representing a firm in a case before the California Supreme Court in a dispute over legal fees, created sufficient doubt as to SeLegue's impartiality in his role as an arbitrator.

    Earlier this year, Howard Rice Partner Jerome Falk was accused of wrongdoing as a result of his decision to exonerate a friend of Ronald George – Thomas Girardi of Girardi & Keese – along with Walter Lack of Engstrom Lipscomb & Lack for misconduct the two committed while litigating a case against Dole Food Company before the Ninth Circuit Court of Appeals.

    During the Ninth Circuit proceedings, and after the case against Dole was dismissed, Chief Judge Alex Kozinski issued an order to show cause why attorneys Walter Lack, Paul Triana, and Sean Topp of Engstrom Lipscomb & Lack, as well as Thomas Girardi and Howard Miller of Girardi & Keese, should not be disbarred or suspended from practicing before the Ninth Circuit.

    Subsequently, in late 2010, a Ninth Circuit panel consisting of Justices William Fletcher , Marsha Berzon, and Randy Smith found that Lack and Girardi had committed grave misconduct which included "the persistent use of known falsehoods," and that the "false representations" were made "knowingly, intentionally, and recklessly" during years of litigation.

    Despite the Ninth Circuit's determination, in his capacity as special prosecutor, and after reviewing the Ninth Circuit file, Howard Rice partner Jerome Falk chose to not file any disciplinary accusations against Thomas Girardi and Walter Lack, stating that he believed Lack's misconduct was not intentional.

    Recently, a shocking discovery was made concerning the fact that Thomas Girardi and Walter Lack were actually clients of Jerome Falk and Howard Rice.

    Separately, partner Douglas Winthrop, as reported earlier, is under extreme scrutiny in matters relating to the now-defunct charity CaliforniaALL.

  • State Bar of California / California Democratic Party / CPUC Cash Flow Connection -- Part 1: LA Mayor Antonio Villaraigosa and State Bar Court Judge Lucy Armendariz

    Maria Lucy Armendariz -- who goes by the name of Lucy Armendariz -- is a 41 years old single mother. Armendariz was born in East Los Angeles. She attended UCLA and later graduated with a law degree from Hastings College of the Law in 1997. After a short stint in private practice, she assumed a government position in Sacramento.

    Unlike the former cocaine addict philanderer who has "platonic sex with friends, lesbians and straight, whatever" who appointed State Bar Court Judge JoAnn Remke to the bench, Antonio Villaraigosa is in a league of his own -- a serial seducer who has been perpetually involved in scandals, sexual and otherwise.

    For example, while carrying on an affair with Mirthala Salinas, a Telemundo reporter, she assumptively reported that the mayor was having an affair, neglecting to mention that the affair was with her. The latest and most recent scandal the Mayor is involved in relates to free tickets to various events, for which his friends in Sacramento help foot the legal bill.


    At the age of 21, Villaraigosa fathered the first of his first four children, after having been involved with the mother for only six weeks. At age 25, his second daughter was born to another woman. In 1987, at age 34, Villaraigosa married Corina Raigosa, who formally ended their relationship in 2009.     In 1994, Villaraigosa ran for California State Assembly. After celebrating his victory, Villaraigosa skipped town for a few days, accompanied by the wife of his closest friend, a Los Angeles County Superior Court judge. Villaraigosa defended his actions, saying, "It is a matter of the heart.” Despite this turn of events, Villaraigosa and his wife reconcile.

    Accrding to Tony Castro, a Los Angeles-based author and journalist, "in the subsequent years, after their reconciliation, friends recall that she was the reluctant political wife, rarely with Villaraigosa in Sacramento while he was in the State Assembly and usually only seen in public with him during local campaign appearances...often overlooked, say friends, is the extent of Corina Villaraigosa's heartbreak, her sense of personal humiliation among friends in the traditionally conservative, Catholic enclave of the Latino Eastside and the emotional journey she went through to accept her husband back amid gossip and rumors of continuing womanizing."

    In 1998, Villaraigosa was chosen by his colleagues to be the first Speaker of the Assembly. From late 1998 to the year 2000, a soon to become a single mother by the name of Maria Lucy Armendariz served on his staff.

  • Op-Ed: Joe Dunn's Voice of OC Irresponsible Journalism Concerning "Sex Acts" by Santa Ana City Council Member Carlos Bustamante

    On September 15, 2011, Democrat Joe Dunn's Voice of OC published a story (written by David Washburn) concerning Santa Ana City Council member Republican Carlos Bustamante.

    The controversy surrounding Bustamante relates to an anonymous letter sent to Orange County officials which raises allegations against Bustamante of a "sexual nature."

    Voice of OC's story concerning Bustamante consisted solely of information that a competing publication – the Orange County Register – had already published about Bustamante.

    However, in order to pillory Bustamante and gain readership, Voice of OC irresponsibly and falsely made reference to "sex acts" involving Bustamante. (See images 1 and 2, below.) Such allegations were reported by Voice of OC, even though the Orange County Register made no mention of any one sex act, sex acts, alone or otherwise on the part of Bustamante. (See image 3 below.)

    In fact, the Orange County Register only reported that an anonymous letter containing "allegations of a sexual nature" had been received.

    This latest controversy concerning Voice of OC follows on the heels of an ongoing inquiry into Joe Dunn, Voice of OC, UCI Foundation (where Joe Dunn serves as Trustee), State Bar of California Foundation, and the sham charity known as "CaliforniaALL."

    CaliforniaALL was created in 2008, collected close to $2 million (from utility companies and a very quiet and unlawful transfer of $780,000 from the Foundation of the State Bar of California), and was dissolved in July 2010.

    According to our sources, an inquiry into the nature and ultimate use of the $2 million received by CaliforniaALL continues. Sources seeking anonymity state that actions by Victor Miramontes of CityView are again being scrutinized due to his "Orange County connections."

    Miramontes, a resident of Texas, was CaliforniaALL's chairman of the board.

  • Law Enforcement Officers Karl Houtman and Toni Congi Visit Home of Dunsmuir Resident Peter Arth.

    Siskiyou County Sheriff Sgt. Karl Houtman and Dunsmuir City Code Enforcement Officer Toni Congi came to the home of Peter Arth, the Mount Shasta Herald reported. The visit was in connection the newly-enacted marijuana cultivation ordinance.


    Mr. Peter Arth Jr., former Chief of Staff to CPUC's President Michael Peevey.

    According to the Mount Shasta Herald, Arth was charged with violations of growing off site of his primary residence, growing outdoors, growing in the downtown historic district, and growing within 300 feet of youth-oriented activities.

    Defiant, Arth refused to sign the citation. He was not arrested.

  • Controversial Former First Lady Cherie Blair Due to Speak at State Bar of California 84th Annual Meeting in Long Beach

    Former first lady Cherie Blair (AKA Cherie Booth) is due to speak at the State Bar of California 84th Annual Meeting in Long Beach, The Leslie Brodie Report has learned.


    Mrs Cherie Blair known professionally as Cherie Booth QC, is a British barrister working in the legal system of England and Wales. She is married to the former Prime Minister of the United Kingdom, Tony Blair. A member of Lincoln's Inn, she became a barrister in 1976 and Queen's Counsel in 1995. Until 1988, her head of chambers was George Carman QC. In 1999, she was appointed a Recorder (a permanent part-time judge) in the County Court and Crown Court. She was Chancellor of Liverpool John Moores University from 1999–2006, and on 26 July 2006 was awarded the honorary title of Emeritus Chancellor. She is also Governor of the London School of Economics and the Open University. She is a founding member of Matrix Chambers in London from which she continues to practise as a barrister.     According to the California Bar: "The British former first lady will share her experiences as a renowned barrister who maintained her legal career while raising children at No. 10 Downing Street, including her clash regularly with the media, who considered her a bad fit for the role and the pressures of combining a demanding career with being a mother of four and the wife of a Prime Minister."

    In his memoir -- A Journey -- Tony Blair wrote:  "That night she cradled me in her arms and soothed me; told me what I needed to be told; strengthened me; made me feel that what I was about to do was right...     According to the Daily Mail, discretion has never been Cherie Blair strong suit. For example, asked how the couple spend their time together when the former prime minister returns from his frequent money-spinning trips abroad. Mrs Blair giggled and told her interviewer: ‘Tony and I have been married 31 years and known each other more like 35 – and even after 35 years he still excites me in all possible ways.'

    The Blairs have a long track record of boasting about their love life. Mr Blair, 57, once claimed he could make love ‘at least' five times a night.

    As a celebrity teacher on Jamie's Dream School, Booth referred to a black pupil as "Banana". The BBC reports she was find for fare dodging after jumping on a train to Luton, where she was due to sit as a magistrate.

    Cherie Blair is currently on a worldwide tour promoting her memoir -- "Speaking for Myself."

  • Inquiry into Attorney Jim Robie of Robie & Matthai Cause of Death-- Part 3: DON'T EAT AND DIVE

    Amid conflicting reports, suspicious circumstances, and vexing questions, The Leslie Brodie Report has launched an inquiry into the untimely death of James Raymond Robie.

    Robie, 61, a named partner at the Los Angeles based law firm of Robie & Matthai, died earlier this year during a SCUBA certification dive off the shore of Santa Catalina Island.

    According to Fox News (See http://tinyurl.com/foxnewsrobie ): "The instructor reported ascending with Robie at about 3 p.m. Sunday in the Arrow Point area, when his body went limp. Dive boat personnel administered CPR for about 20 minutes until paramedics arrived to transport Robie to the Catalina Hyperbaric Chamber. There, the attending physician pronounced him dead at about 4:40 p.m. An autopsy has not been performed."

    Journalist Reza Gostar reported: "Bay Watch Isthmus paramedics responded to a call of a diver in full cardiac arrest at the area of Arrow Point near the west end of Catalina about 3 p.m., according to the Los Angeles County Sheriff's Office. The diving teacher stated he was rising out of the water with Robie when he felt his body go limp. He immediately tried to revive Robie while swimming to the dive boat secured nearby, Attempts to resuscitate Robie by the dive boat staff failed, according to the Sheriff's Department statement. Close to 20 minutes passed before Robie was transported to the Catalina Hyperbaric Chamber."

    Based on the above, and while speculation abounds, seasickness as well as heavy consumption of food prior to the dive, may have caused the diver to vomit while underwater.

    MEALS ON A SAND DOLLAR AND THERE IS NEVER A BILL
    According to various accounts, the boat that was allegedly involved was the Sand Dollar -- notorious for the terffic food it serves on board. Some of the reviews (emphasis added) read :

    "Well, we are back on dry land! As always, Catalina delivered great water and amazing dives. The weather held off for us to keep warm and enjoy everybody's company too. The crew of the Sand Dollar took great care of all who were on the boat.. We dove in several sites from Fragle Rock, the Quarry, Torqua Springs, Italian Gardens and many more. The food on the boat was superb! Chef Donna prepared everything from homemade chili and stew to a great roast and potatoes.     American Journal of Forensic Medicine & Pathology Recommendations
    Scuba diving fatalities are rare and sometimes extremely difficult to explain. A thorough forensic investigation, conducted by a qualified team, helps avoid possible later questions and doubts, family concerns and judicial matters, since a significant body of evidence is lost after the body of the victim is buried or the equipment is reused.

    We report about a death of a scuba diver who was drowned while diving to the depth of 30 meters. Before being assisted to the surface, the diver panicked and removed the regulator from his mouth. The technical expertise of the scuba gear and the chemical analysis of the air from the high-pressure cylinder revealed no irregularities. Homicide, suicide, nitrogen narcosis, oxygen toxicity, and regulator malfunction were ruled out as possible causes of death.

    The most probable cause that triggered the event was vomiting into the regulator, as confirmed nearly 4 years later by the toxicological analysis of the traces of matter found in the dry chamber of the breathing regulator.     Talk Diving Recommendations
    Eat well. A good breakfast with plenty of slow-burn carbohydrates will set you up for a day of scuba diving. Oats, wholemeal breads and fruits are a good option. Avoid the greasy fried 'full English', it will sit in your stomach for hours and make you feel lethargic. If you are diving after lunch have a pizza. Never scuba dive on a full stomach as you could suffer cramps and sink like a stone, after a meal always leave a couple of hours before you enter the water.     Typically, there are five stages to drowning:

    1. Surprise -- In this stage, the victim recognizes danger and becomes afraid.

    2. Involuntary Breath Holding -- This occurs because water has entered the mouth and causes the epiglottis to close over the airway. Though a victim may continue to struggle, he/she will not usually make any sounds as he/she cannot breathe. Without oxygen, the victim will lose consciousness.

    3. Unconsciousness --Because the victim has been without oxygen, the body shuts itself down as unconsciousness results. In this stage, the victim will be motionless.

    4. Hypoxic Convulsions -- Due to the lack of oxygen in the brain, the victim may look as if he/she is having a convulsion, which is why this stage is called the hypoxic convulsion stage. The victim's skin turns blue, especially in the lips and fingernail beds, and the body may appear rigid.

    5. Clinical Death -- The final stage in the drowning process is death. Clinical death occurs when both breathing and circulation stop. The victim is in cardiac arrest. The heart stops pumping blood. The vital organs are no longer receiving oxygen rich blood. The lack of oxygen causes the skin to turn blue.

    Hello, this is my first post on this forum. To get started, I don't SCUBA dive, I free dive, but I knew this would be the place to come to gather information.

    I was sailing about five miles from the Angel's Gate (Port of Los Angeles) when I heard on Channel 16 a distress call from a 65 foot commercial dive boat The Sand Dollar which was operating near Two Harbors, Catalina. The coast guard was communicating directly with the captain or some commander on the boat and this is what I gathered.

    There was 35 people aboard and a man 60 years old named Robbie had surfaced and was unconscious, not breathing and when asked to describe his skin color the man on the radio said "blue". This was all after he had been out for two minutes. There was an EMT on board since it was a dive boat with customers, I assume, and he was administering CPR.

    The coast guard radio op asked about the details of the dive. He said the man had taken part in three, thirty minute dives at thirty feet deep with fourty-five minutes of rest in between each dive. After this initial information was gathered the conversation dropped off channel 16 and I heard nothing else.

    I can't find any information online about what happened except a Twitter post saying that somebody died on Catalina in a dive incident, and it hasn't been in the news yet. That's why I've come here, because I literally listened as the events unfolded and of course I'd like to have a little follow up. If anyone has any information, lets make it public.

    Assuming the man has died, we can only hope he died happy and that life was good to him. Condolences to his family and friends as well. I'm sorry, and this should serve as a reminder to stay safe.

  • Ex-Convict Tony Serra "Soured" Towards Client -- Former Convict Jamie Harley

    Ex-Convict Tony Serra, a San Francisco based attorney, seeks permission to withdraw from further representation of client -- former convict Jamie Harley (AKA Jamie Harmon) -- in an upcoming trial for money laundering.

    In a request submitted to the court, Serra wrote "There exist conflicts regarding proceedings in the case. Defendant's office and I have differing opinions, approaches, and methodology, which makes continuing representation impossible."


    Ms Jamie Harley (AKA Jamie Harmon), 53, of Morgan Hill, Calif., a criminal defense lawyer based in San Jose who had previously worked as an assistant district attorney with the County of Santa Clara for fourteen years. Harley was previously convicted of five counts of money laundering in a San Jose Federal Court. Subsequently, and while represented by Serra, she won a motion for a new trial.

    "From my perspective, Defendant has defamed me. She has severely admonished me to stop claiming that I wrote the Motions herein. I certainly did not write the Motions, and I have never claimed that I did so, but I infer that she persists in such false representations to others, all of which has "soured” me towards her," Serra wrote.

    Tina Watson was a 26-year- old American woman from Alabama. She died on her honeymoon on the Great Barrier Reef in Queensland, Australia in 2003. She had only been married to her husband, David Gabriel "Gabe" Watson, for 11 days when she died. The doctor who performed the autopsy said she drowned in a scuba diving accident.

    During the dive, Watson allegedly pulled his wife's oxygen tube free and held on to her until she lost consciousness.

  • Orange County Investigative News Agency "Voice of OC" Asked to Produce all Documents Submitted to the Internal Revenue Service Within the Past Three Years -- CaliforniaALL Part 21

    Orange County's Nonprofit Investigative News Agency "Voice of OC" has been served with a demand to produce all records it had submitted to the Internal Revenue Service within the past three years, The Leslie Brodie Report has learned.

    The request followed shortly on the heels of a letter informing State Bar Executive Director Joe Dunn about the existence of convenient circumstances surrounding sham charity CaliforniaALL and his publication -- "Voice of OC."

    More specifically, and according to a source, the fact that some individuals and entities involved in the creation of sham charity CaliforniaALL and the subsequent unlawful transfer of $780,000 from the Cal Bar Foundation to CaliforniaALL were also involved in assisting Mr. Dunn with the creation of "Voice of OC", has caused the source to entertain the thought that "Voice of OC" may have been a recipient, at least in part, of the $780,000 misappropriated from the State Bar of California.

    CaliforniaALL, a 501(c)(3) charitable entity, was the brainchild of Ruthe Ashley (a Diversity Officer at CalPERS and Vice-President of the State Bar of California) and Peter Arth Jr., Chief of Staff to CPUC President Michael Peevey.

    In its brief existence from 2008 to 2010, CaliforniaALL collected close to $2 million from utility companies (AT&T, PG&E, Verizon, Sempra), including a sub-rosa contribution of $769,247.00 from the State Bar of California Foundation (DBA California Bar Foundation.)

    CaliforniaALL was abruptly dissolved in June of 2010.

    Morrison & Foerster, specifically Susan Mac Cormac , assisted with the legal aspects of creating the entity. Later, Sarah Redfield assumed the position of CaliforniaALL's Interim CEO; after a simulated search for a CEO, Ruthe Ashley was hired as the entity's president and CEO.

    Once Ashley assumed the position, the Foundation of the State Bar of California (which is under the complete control of the BOG) made a quiet and unlawful transfer of approximately $780,000 from Cal Bar Foundation to CaliforniaALL. At the time of the transfer, the individuals controlling the Foundation were Holly Fujie, Girardi & Keese's Howard Miller, Howard Rice's Douglas Winthrop, Geoffrey Brown, and a few others.

    CaliforniaALL never acknowledged receipt of the approximate $780,000 from the Cal Bar Foundation in any of its publications, although it did acknowledge the transfer on its IRS tax returns. Likewise, California Bar Foundation never acknowledged the largest grant it ever bestowed in its newsroom, the California Bar Journal, or similar publications; it did, however, recognize the transfer on its IRS returns, and in a 2 by 2 inch blurb in its annual report.

    As the purpose of CaliforniaALL was to transfer those funds forward, it did so by awarding approximately $300,000 in grants to the UCI Foundation, where Mr. Dunn serve as trustee and chair of the Audit Committee.

    In September 2009, Ruthe Ashley abruptly exited CaliforniaALL. In the same month and year, Mr. Dunn publicly launched the online publication, "The Voice of OC." Public sources have stated that the Voice of OC was financed by various foundations, unions, and the like.

    Additionally, and according to the source, the belief is heightened given various events' proximity in time -- as noted above, Ruthe Ashley left CaliforniaALL in the same month Mr. Dunn launched "Voice of OC" (as though her mission had been completed).

    Moreover, the recent abrupt departure of Thomas Girardi and James Brosnahan from 'Voice of OC" ( as though they were fleeing the scene with guilty consciences), the refusal of SAL-UCI to disclose the amount it receive from CaliforniaALL, the simulated RFP, and CaliforniaALL's pre-selection of the UCI Foundation as a recipient of funds only reinforce the suspicion. This is heightened by Mr. Thomas Girardi's lack of credibility (pursuant to findings made by a panel of federal judges), and the friendship Mr. Dunn shares with Mr. Girardi.

    The request was for all documents submitted to the IRS within the past three years, which generally means the three most recent returns, and include IRS Form 990, Form 990 Schedule A, as well Form 1023.

  • U.S. Government to Re-File Charges Against Jamie Harley (AKA Jamie Harmon)

    Silicon Valley based attorney Jamie Harley (AKA Jamie Harmon), will again face a jury of her peers.

    Harley, a prosecutor turned criminal defense lawyer turned defendant was previously convicted of five counts of money laundering in a San Jose Federal Court.

    Later, citing error in the instruction given to the jury, U.S. District Court Judge James Ware stated Harley is entitled to a new trial.


    Ms Jamie Harley (AKA Jamie Harmon), 53, of Morgan Hill, Calif., a criminal defense lawyer based in San Jose who had previously worked as an assistant district attorney with the County of Santa Clara for fourteen years.

    According to the San Jose Mercury News : "The U.S. attorney's office revealed that it is pressing ahead with the criminal case against Harley, accused of laundering money for a former client in a controversy that now stretches back eight years."

    In July of 2010, a San Jose federal jury found that Harmon laundered monies back to a former client on five separate occasions. Evidence presented at trial showed that Harmon accepted two checks made payable a used computer equipment previously owned and operated by her former client, Christian Pantages.

    Pantages testified that he told Harmon from the first time he is in the illegal business of buying and selling stolen equipment, and therefore the two checks Harmon accepted were proceeds from the sale of stolen computer hardware.

    Harmon testified that she indeed agreed to take the checks and deposit them into her attorney client-trust account and later wrote and directed others in her law office to issue several checks of varying denominations back to her client Pantages and his wife. The jury convicted Harmon of money laundering monetary instruments, knowing that the checks constituted the proceeds of the sale of stolen property, in an effort to conceal or disguise the nature of those funds.

    Separately, beginning in 2005, the State Bar of California charged Harley with 20 counts of professional misconduct in 10 client matters occurring from 2002 to 2006. It sought disbarment, alleging that her misconduct involved disrespect and dishonesty to the court and inattention to clients, including mishandling of their funds and files.

    Shockingly, an all-female panel of judges (JoAnn Remke, Judith Epstein,Catherine Purcell) reasoned that Harley's misconduct was mainly the result of "mismanagement", ordered Harley suspended for 6 months.

    Amid growing concerns, The Leslie Brodie Report has launched an inquiry into the untimely death of American Legend Lee Roy Selmon.

    Selmon, 56, who gained fame as a football defensive lineman, died earlier today as a result of a massive stroke he had suffered only two days ago. Selmon was a member of the NFL Hall of Fame.

    Prior to suffering the massive stroke, a very upset Lee Roy Selmon spoke to the The Tampa Tribune. He stated:

    "I want to clear this up, I have not filed any lawsuit whatever. I have no intention whatsoever of filing a lawsuit. I'm upset about this. All I know is the same as you guys (media) have been finding out, but no one involved in this has talked to me."

  • TLR Launched a Journalistic Inquiry into Attorney James R. Robie Cause of Death -- Part 1

    Amid conflicting reports and unanswered questions, The Leslie Brodie Report has launched an inquiry into the untimely death of attorney James R. Robie.

    Robie, 61, a named partner at the Los Angeles based law firm of Robie & Matthai, died earlier this year while SCUBA diving off the shore of Avalon, California.

    On January 16, 2011 Robie had been diving with an instructor when "his body went limp" as the two ascended to the surface.

    On January 18 of 2011, journalist Reza Gostar reported that Robie had died as a result of a heart attack. Specifically, Gostar wrote:

    "James Raymond Robie, a 61-year-old resident of Pacific Palisades, died Sunday after having a heart attack during a dive near Santa Catalina Island."

    Protecting the privacy and identity of his sources, Reza Gostar did not elaborate on the circumstances by which he became familiar with Robie's cause of death.

    Additionally, and in the same article, Reza Gostar wrote:

    “The investigation is still ongoing,” said Lt. Joseph Bale of the Los Angeles County Coroner’s Office. “The cause of death hasn’t been ruled.”

    CaliforniaALL, a Section 501(c)(3) charitable entity, came about as a result of a San Francisco restaurant meeting between Ruthe Ashley (a Diversity Officer at CalPERS and Vice President of the State Bar of California) and Peter Arth, Jr., Chief of Staff to CPUC President Michael Peevey. Also present at that meeting was Professor Sarah E. Redfield.

    CaliforniaALL's alleged purpose was to award grants to entities that would increase minority participation in the "pipelines" that feed into various industries, such as finance, technology, and law.

    Donations to CaliforniaALL came primarily from utility companies (including AT&T, Sempra Energy, and PG&E). In its brief existence from 2008 to 2010, CaliforniaALL collected close to $2 million, including an unusually large sub rosa contribution of $780,000 from the State Bar of California Foundation in 2008.

    Mr. Geoffrey Brown, currently a professor of law at JFK School of Law. Between 2001 to 2007 served as Commissioner with the CPUC. From 2006 to 2009 Brown serve as director with the State Bar of California Foundation (DBA "California Bar Foundation"). In 2008, California Bar Foundation quietly transferred $769,247.00 to CaliforniaALL.

    Other than in Foundation tax records and a 2 by 2 inch blurb in its 2008 annual report, the sub rosa contribution was never mentioned again – not by the State Bar of California, not in the Cal Bar Journal, not in the Foundation's "newsroom," and not by anyone or any publication of CaliforniaALL.

    CaliforniaALL was abruptly dissolved in July 2010.

    As we previously mentioned, Leslie Hatamiya -- Executive Director of the California Bar Foundation who colluded with Holly Fujie, Ruthe Ashley, Patricia Lee and Judy Johnson in order to maintain secrecy over the unlawful transfer of $780,00.00 from California Bar Foundation to CaliforniaALL -- has resigned and a search for a replacement is underway.

    Sources with knowledge of the inquiry into CaliforniaALL, speaking on condition of anonymity, maintain the ongoing multi-prong inquiry is continuing and expanding, and that a red flag continue to fly over Joe Dunn, "The Voice of OC", Thomas Girardi, Holly Fujie, Douglas Winthrop, Ruthe Ashley, Sarah Redfield, and Geoffrey Brown due to convenient circumstances surrounding CaliforniaALL, UCI Foundation, Voice of OC, CPUC, State Bar of California, and the California Bar Foundation.

    In CaliforniaALL Part 18, we published a letter from Ms. Sperber to complainant. CaliforniaALL Part 19 is a reply from complainant to Ms. Sperber, below:

    Dear Ms. Sperber:

    This will respond to your correspondence of July 28, 2011 advising that you have closed the complaint filed by me in this matter.

    Setting aside the fact that you improperly ruled on the complaint rather than forwarding it to outside counsel, and as it clear that your letter is imbued with factual misrepresentations, let me help you with a more plausible defense which I am willing to accept provided respondents concede the factual accuracy of the statements.

    Specifically, what you should have written is as follows:

    "Dear Sir:

    I have reviewed your complaint, and have come to the conclusion that it lacks probable cause sufficient to forward it to an outside counsel for further examination.

    While the State Bar of California concedes that it was under a duty to inform both plaintiff Granda as well as Judge Morrison England of its relationship with CaliforniaALL, given the exigency of the circumstances as explained below, no intentional misconduct took place. Nevertheless, I thank you for bringing this matter to our attention. Rest assured that the State Bar has taken corrective actions to ensure that such conduct will not be repeated.

    Once the Office of the General Counsel was served with the complaint/emergency motion for preliminary injunction filed by Ms. Granda, the State Bar immediately forwarded the papers to the law firm of Kerr & Wagstaffe, which was under a tight deadline to file a response to the emergency writ.

    At this point, and even though the names of Yee, Torres-Gil, and Grunberg appear on all the pleadings submitted, outside counsel Michael von Lowendfelt was the attorney in control of the case.

    Initially, the matter was assigned to a magistrate judge, and only later was assigned to Hon. Morrison England. Judge England had only a few days to rule on the matter, which he did by dismissing the case in its entirety.

    As Mr. von Lowendfelt was unaware of the existence of CaliforniaALL and its enmeshment with the State Bar of California vis-a-vis the role the State Bar played in appointing and re-appointing CaliforniaALL's members of the board of directors throughout the entire time CaliforniaALL was in existence, he did not speak up. Additionally, given that the matter was only pending before Judge England for a few days, in house attorneys Yee, Gil-Torres, and Grunberg, as well as Ms. Johnson, also did not speak up, albeit unintentionally so.

    When a complaint is closed at this level, the complainant may request that the State Bar's Audit and Review Unit review the determination, which you may do within 90 days of the date of this letter.
